These Terms of Service ("Terms") govern your access to and use of the byteshark.tech website, the Whitetip tool, and other tools and information provided by Byteshark LLC ("Byteshark," "we," "us," or "our"). By using them, you agree to these Terms. If you do not agree, do not use them.

1. Who we are

2. What these Terms cover

These Terms cover your use of our website and self-serve tools. Paid professional services — including penetration testing, malware analysis, cyber-insurance readiness, and research briefs — are governed by a separate written engagement agreement or statement of work. If that agreement conflicts with these Terms, the engagement agreement controls for that work.

3. Whitetip and informational tools

Whitetip and similar tools provide informational assessments only. A verdict such as "likely phishing" or "likely safe" is a best-effort opinion generated from the information you submit. It is not a guarantee, and it is not a substitute for your own judgment or your organization's security controls. You are responsible for decisions you make about any message, and you should never act on a message you believe is dangerous simply because a tool labeled it safe.

When you submit content to Whitetip, you confirm you have the right to share it with us for analysis. Do not submit content you are legally prohibited from sharing.

4. Acceptable use

You agree not to:

  • Use our tools or services to break the law or infringe anyone's rights.
  • Attempt to disrupt, overload, reverse-engineer, or gain unauthorized access to our systems.
  • Submit malware to our public tools except through the channels we designate for that purpose.
  • Misrepresent your identity or your authority to submit information.

5. Security testing requires written authorization

Byteshark performs offensive security work (such as penetration testing) only under a signed agreement and rules of engagement that define scope, timing, and authorization. Nothing on this website authorizes testing of any system, and you may not interpret any content here as permission to test systems you do not own or are not expressly authorized in writing to test.

6. No warranty

Our website and tools are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the tools will be uninterrupted, error-free, or that any assessment will be accurate or complete.

7. Limitation of liability

To the fullest extent permitted by law, Byteshark and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of your use of the website or free tools. {{Confirm the liability cap and any carve-outs with counsel; liability for paid engagements is set in the engagement agreement.}}

8. Indemnification

Our site may link to or rely on third-party services (for example, fonts or hosting). We are not responsible for third-party content or practices.

11. Governing law
